Welcome to Lightz by Zack. By accessing or using our website, you agree to the following terms and conditions. Please read them carefully before submitting any personal information or requesting services.

1. Website Usage

Our website is intended to provide information about our services and allow visitors to submit quote or contact requests. We also share seasonal blog content and tips for homeowners. No payments are processed through our website.

2. Service Warranty

We offer in-season maintenance as part of our light installation services. If an issue arises with the lighting while in-season, we will return to address the problem at no additional charge.
Note: This warranty is only valid if Lightz by Zack stores the lights. If the client stores the lights independently, the warranty is void.

3. User Accounts

No user accounts are required to use our website. Customers do not need to log in or create profiles.

4. Service Limitations

Our services are weather-dependent. For safety reasons, work will not be performed:

  • During heavy rain

  • When temperatures fall below freezing

  • At night

We aim to provide accurate arrival windows, but installation times may vary depending on the day's workload. We reserve the right to decline service due to safety concerns or at the owner’s discretion.

5. Text Message Consent

By submitting a contact form, quote request, or any intake form on our website, you automatically consent to receive text messages from Lightz by Zack via our third-party platform, SimpleTexting. These messages may include:

  • Appointment confirmations

  • Service updates

  • Seasonal reminders

  • Promotions or service notifications

Message and data rates may apply. You may opt out at any time by replying STOP to any message.

6. Limitation of Liability

While we take every reasonable precaution, Lightz by Zack and its employees are not responsible for:

  • Incidental damages related to service performance (e.g., fragile roofing, loose gutters)

  • Delays due to weather or schedule conflicts

  • Any loss of service caused by inaccurate or missing client information

7. Conflict Resolution

At Lightz by Zack, we are committed to professionalism, transparency, and treating our clients with the same respect and care we extend to our own families. If any concerns arise during or after your service, we ask that you notify us directly so we can work together to find a fair and timely resolution. We believe that most issues can be resolved through honest communication and shared understanding.

We do not tolerate hostile or abusive behavior toward our team and reserve the right to discontinue service at any time if mutual respect is not maintained. In the rare event that a satisfactory solution cannot be reached informally, disputes will be addressed in accordance with the laws of the State of Texas and may be resolved through mediation before any legal proceedings are considered.

Dispute Resolution & Jurisdiction
By submitting a service request, approving an estimate, or booking services with Lightz by Zack, you agree to the following:

  1. Initial Resolution: In the event of a dispute, both parties agree to first attempt resolution through direct, respectful communication.

  2. Mediation and Binding Arbitration: If a resolution cannot be reached, both parties agree to engage in non-binding mediation followed, if necessary, by binding arbitration. Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA), and held in Harris County, Texas. The decision of the arbitrator will be final and legally enforceable in any court with appropriate jurisdiction.

  3. Waiver of Class Action: All claims must be brought on an individual basis, and not as part of any class or representative action.

  4. Jurisdiction: Any legal matters that do proceed to court (e.g., to enforce arbitration or for injunctive relief) shall be governed by the laws of the State of Texas, and heard in a court located in Harris County, Texas.

  5. Consent: You acknowledge that you have read, understood, and agreed to these terms by submitting a service inquiry, approving a quote, or completing a booking with Lightz by Zack.
